The Nizams Dominion, the objectives where of are enunciated in paragraph 2 of the Memorandum of Sanctioned Bye-Laws of this Sabha. Now the aim of this Sabha, with a view to accomplish, what is contained in Sub-clauses 2,3 & 8 of the aforementioned Paragraph is to make a permanent arrangement, so as to facilitate collection of subscriptions, securing of donations, purchasing of property and its preservation. The Sub-Clauses 2: 3: 8 under clause 3 are extracted as follows.

 

Sub Clause (2) Educational Economic and Religious, progress of Rajput brotherhood.

 

Sub Clause (3) for fulfillment of the objects contained in sub clause (2) purchasing of immovable property, its construction, renovation and extension are also included.

 

Sub Clause (8) All such valid actions and their execution which are essential and conclusive to the fulfillment of herein above mentioned objectives.

 


The Executive Committee of this Sabha after due and careful consideration resolved that it should set up a permanent Trust Board composed of suitable Rajput persons prescribing proper and adequate conditions. Keeping in view the above mentioned reasons and subject to conditions set-forth here under a Board with the following members is constituted, whose names are also mentioned hereunder :-

FUNDS OF THE TRUST BOARD:

 

Clause 1. The funds collected from various sources for the purposes of the Trust will be held as "Trust Fund" In the first instance it will be necessary to purchase of construct with the Trust Fund a Hostel building. Thereafter, permanent sources will be found to meet expenses of the Hostel and from profits or income from such sources expenses of the Hostel will be met. However after sufficient permanent sources are found, some portion of the corpus money would be utilized for the recurring expenditure.

 


Clause 2. The Trust Fund will be spent or utilized for the following purposes:

 

a) Establishment of Educational and Technical institutions.

b) Setting up of Hostel.

 

Clause 3. In course of time and first of all a hostel building will be constructed or purchased. Thereafter, permanent sources of income will be created with which to defray day to day expenses of the hostel, so that there should be no hindrance or difficulty encountered in the functioning of the hostel.

 

Clause 4. After purchasing or construction of hostel building admissions of students will be started only when there will be permanent minimum monthly income of Rs. 60/-. Apart from this, whatever income will be derived 1/5th or say 20% thereof will be deposited as "Reserve Fund" and from out of such "Reserve Fund" a suitable part thereof, which in no case will exceed 50% could be utilized in unavoidable circumstances to meet unforeseen expenses during the whole year.

 

Clause 5. All Trustees shall be Rajput’s (Kshatriyas) only.

 

Clause 6. The total strength of the Trustees will be nine, of whom one Trustee will be the president of the Sabha, who will preside over the Trust Board. The remaining Trustees will be permanent. In case the resident of the Sabha is already Trustee, then instead of him the Vice-president, and in case the Vice-president is already a nominated Trustee than any other member of the Executive Committee (except the Secretary of the Sabha) duly nominated by the Executive Committee of the Sabha will be the President of the Trust Board.

 

Clause 7. The powers of the Trust Board will be as detailed hereunder: - POWERS A. Preservation and augmentation of the Trust Fund. B. Utilizing the Trust Fund for the purposes of the Trust. C. Supervision, administration and protection of Trust property. D. Construction and inauguration of the hostel, its management, supervision, and upkeep of the students housed in it. E. Preparation of proper budget. F. The president of the Trust Board will be empowered to accept all donations. However, day to day business will be carried out by the President assisted by two other members of the Trust Board. The two such other Trustees will be nominated by the Trust Board.


Clause 8. The responsibilities and duties of the Trust Board will be as follows: DUTIES AND RESPONSIBILITIES A. Guarding against any abuse and misuse of the funds and properties of the Trust for purposes which are opposed or contrary to the avowed objectives of the Trust. B. Retraining from appropriating the Trust Funds or Trust property or any part thereof for any type of personal benefit. C. Preparing and maintaining complete and property documented accounts of the Trust Fund and the receipts and expenditure of the Trust, and taking action within sanctioned budget. D. Sending replied to the enquired made by the Sabha and scrupulously complying with the proposals approved by and directions by this Sabha issued in accordance with the conditions laid down in this Trust Deed.

 

Clause 9.Trust Board will be empowered to do all such acts necessary for fulfilling the objects of the Trust.

 

Clause 10.The Trust Board will not be empowered to pledge, incumber, sell or transfer the Trust property.

 

Clause 11. The Sabha will not be empowered to extinguish the Trust Board or to remove any Trustee except as provided in clause 14 or bring about in any manner or cause any changes in the Trust Deed except as provided in Clause (23).

 

Clause 12. The Sabha will not interfere with the administrative matters of the Trust Board. Explanation: - Administrative matters mean only such matters which are meant for the performance of Duties of Trustees within powers given to them.

 

Clause 13. The Trust Board will admit students sponsored by the Sabha to the extent of the available budget provision.

 

Clause 14. Any Trustee found guilty of grave misconduct, insolvency, fraudulent transactions or activities smacking distrust will be expelled (removed) by the Executive Committee of the Sabha by convening, consulting and with concurrence of other Trustees.

 

Clause 15. Vacancy caused by relinquishment, disability, or death of the Trustee will be filled by the Executive committee of this Sabha with the concurrence of the Trust Board.

 

Clause 16. The Trust Board shall not have the power to give admission to any student without the channel of the Sabha.

 

Clause17. Trust Board will be empowered to formulate procedure for performance of its functions, duties and responsibilities which should not be contrary to the conditions laid down in this Trust Deed.

 

Clause 18. The Trust Board will continue to exist even when the Sabha is dissolved or suspended and powers of the Sabha, so far as they relate to the functioning of the Trust, will be wholly transtered to the Trust Board.

 

Clause 19. The Trust Board will have the power to suspend any student with the permission of the Sabha and to expel such student from the hostel.

 

Clause 20. The Trust Board will have no power to receive any funds opposed to the purposes of the Trust.

 

Clause 21. The Trust Board will have no power to set up or establish and run any other educational or technical institution except setting up and running the Hostel.

 

Clause 22. This Sabha will have power to appoint any person or persons to audit the accounts and to inspect the functioning of the Trust Board. Such person or persons will report to the Sabha, after carrying out the audit of the Accounts and after inspecting the working of the Trust Board, the Sabha will then, after considering such report become tent to draw the attention of the Trust Board to the Short comings reported and will also be empowered to issue suitable instructions. It will be incumbent on the Trust Board to comply and act in accordance with such instructions issued by the Sabha. If in the opinion of the Trust Board, such instructions of the Sabha or any part thereof tend to militate against the avowed objectives of the Trust or tend to cause obstruction in the working of the Trust Board or strain the budget of the Trust Board, then the Board may decline compliance with such instructions or part thereof. In such an even quality it will be incumbent on the Trust Board to inform its decision with cogent reasons to the Sabha.

 

Clause 23. Whenever, in the opinion of the Trust Board, the conditions governing the Trust Board or any part thereof in the future and by afflux of time, cause obstacties or prevent performance of the functions related to the objectives of the Trust, then the Trust Board will submit proposals to this Sabha explaining valid reasons to amend or change them. Such proposals will be given effect to only after they are approved by the executive committee of the Sabha with 3/4 majority vote. But under no circumstances, conditions and stipulations mentioned in this Trust Deed or any part or parts thereof will be altered/amended which will directly or indirectly affect the real objectives of the Trust.
Hence after full deliberations and careful consideration this Trust is executed and got registered as the "Deed of Trust" so that used as testimony whenever needed.

APPOINTMENT LETTER OF TRUSTEES UNDER THE TRUST DEED KSHATRIYA RAJPUT SABHA

DEED OF APPOINTMENT OF TRUSTEES


WHEREAS by virtue of the Bye-Laws (Rules) of the KHASTRIYA RAJPUT SABHA, Hyderabad-Deccan (vide Registration No:7/53, Fasli Documents No:1 & 2 dated 16th Thir, 1353 Fasli) and for the fulfillment of the objects enunciated in Clauses (2) (3) and (8) under paragraphs 3, of the Memorandum attached to and registered along with the said Bye-Laws and in exercise of powers conferred thereunder, the Executive Committee (Majlis-e-Amela) of the said KHASTRIYA RAJPUT SABHA had resolved and accordingly established a permanent Trust Board by executing and getting registered a Trust Deed on 11th Ardibehisht 1354 Fasli (on or above 18th March, 1945 A.D.), subject to the conditions set-forth therein and nominating and appointing the following persons as the Trustees of the said Trust Board after purchasing and investing in the Trust Board a vast immovable property comprising buildings and open land admeasuring about 7 acres with enclosure situated on main road to Amberpet from Kachiguda in Hyderabad City:-
